Welcome to Rommé. These Terms and Conditions apply when you access our website, purchase from us or otherwise use our services.
In these Terms, “Rommé”, “we”, “us” and “our” refer to [insert legal business or company name], trading as Rommé. “You” and “your” refer to the person accessing our website or purchasing from us.
By using our website or placing an order, you agree to these Terms and Conditions and our Privacy Policy, Shipping Policy and Returns Policy.
1. Eligibility to purchase
By placing an order with Rommé, you confirm that:

You must not use our website or products for an unlawful or unauthorised purpose.
2. Product information
We take reasonable care to ensure that product descriptions, measurements, materials, colours, images and prices are accurate.
Each Rommé piece is individually crafted. Small variations in dimensions, finish, setting, texture and appearance may occur as a natural part of the making process. These variations are not necessarily faults and contribute to the individual character of each piece.
Gemstones, pearls and other natural materials may vary in colour, tone, clarity, pattern and appearance. Lab-grown gemstones may also show minor variations between stones. Product photographs are representative, and the colour displayed on your screen may vary depending on your device and settings.
Stone measurements, carat weights and jewellery dimensions may be approximate unless expressly stated otherwise.
If a product materially differs from its description or does not meet a consumer guarantee, your rights under the Australian Consumer Law will apply.
3. Prices
Unless otherwise stated:

Prices displayed on our Australian website are in Australian dollars

Prices include GST where GST is applicable

Delivery charges, duties and taxes are calculated or disclosed separately

International orders may be charged in another currency where supported by our website or payment provider
Prices may change without notice. A price change will not affect an order we have already accepted.
If a product is displayed with an obvious pricing or descriptive error, we may contact you to correct the error before accepting or fulfilling the order. You may choose to proceed at the corrected price or cancel the affected order for a full refund.
4. Placing an order
When you place an order, you are making an offer to purchase the selected products under these Terms.
Receiving an order confirmation does not necessarily mean that we have accepted your order. We may review payment, stock, production capacity, delivery details and suspected fraud before accepting it.
An order is accepted when we confirm acceptance, begin production or dispatch the product, whichever occurs first.
We may decline or cancel an order on reasonable grounds, including:

A product or material being unavailable

An obvious pricing or product-description error

Payment being declined or reversed

Suspected fraud or unauthorised activity

Delivery being unavailable to the nominated address

An order appearing to be placed for unauthorised resale
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item.
5. Made-to-order jewellery
Unless identified as ready to ship, Rommé jewellery is generally handcrafted to order.
Our estimated production period is approximately 2 to 4 weeks before dispatch. This is an estimate rather than a guaranteed completion date. Production may take longer during busy periods or where there are delays involving gemstones, materials, specialist craftspeople or quality-control requirements.
We will contact you if we become aware of a significant delay.
Made-to-order does not necessarily mean personalised or custom-made. Your eligibility for a change-of-mind return will be determined by our Returns Policy and the nature of the piece.
Nothing in this section limits your rights under the Australian Consumer Law, including any rights that may arise if a product is not supplied within an agreed or reasonable time.
6. Ready-to-ship jewellery
Products identified as ready to ship are generally dispatched within 2 to 5 business days after payment and order verification.
If an order contains both ready-to-ship and made-to-order products, the complete order may be dispatched together once every piece is ready. We may choose to send items separately at our discretion.
7. Custom and personalised orders
Custom or personalised products may include pieces made to a unique design, engraved pieces, specially sourced gemstones, non-standard sizes or products altered specifically at your request.
You are responsible for reviewing and approving all relevant details before production begins, including spelling, dates, measurements, ring size, metal, gemstone and design selections.
Once we have begun production or committed to purchasing materials for a custom or personalised order, the order generally cannot be changed or cancelled for change-of-mind reasons.
Custom and personalised products are not generally eligible for change-of-mind returns. This does not exclude or limit any rights you have under the Australian Consumer Law if the product is faulty, materially different from what was agreed or otherwise fails a consumer guarantee.
8. Ring sizing
You are responsible for selecting the correct ring size when ordering.
Sizing can vary slightly between different ring styles, band widths and manufacturers. We recommend having your finger professionally measured before placing an order.
If you order an incorrect size, resizing may not be possible for every design or material. Where resizing is available, additional production, material and delivery charges may apply.
An incorrect size selected by the customer is not considered a product fault. Your rights under the Australian Consumer Law remain unaffected where a ring is supplied in a size different from the size ordered.
9. Payment
Payment must be made using one of the payment methods displayed at checkout.
Your order may be subject to verification by us, Shopify, your financial institution or the relevant payment provider. We are not responsible for delays caused by declined payments, payment-provider reviews or incorrect payment information.
If a payment is reversed, disputed or found to be unauthorised, we may pause production, withhold dispatch or cancel the order where reasonably necessary.
Any payment-plan or buy-now-pay-later service is also subject to the provider’s separate terms and conditions.
10. Changes and cancellations
If you need to change or cancel an order, contact us as soon as possible at [insert customer-service email].
We cannot guarantee that a request can be accommodated after an order has been accepted or production has begun.
Approved changes may affect the price and production timeframe. Additional costs may apply if materials have already been ordered or work has commenced.
Your statutory cancellation and refund rights are not affected.
11. Shipping and delivery
Shipping options, charges and estimated delivery periods are displayed at checkout or explained in our Shipping Policy.
Delivery estimates begin after production is complete and do not include the production period for made-to-order products.
Delivery times are estimates and may be affected by events outside our reasonable control, including carrier delays, customs processing, severe weather, industrial action and incorrect delivery information.
You are responsible for providing a complete and accurate delivery address. If you notice an error, contact us immediately. We cannot guarantee that an address can be changed after dispatch.
Where tracking or signature delivery is provided, you are responsible for monitoring the shipment and arranging collection or redelivery where necessary.
We will provide reasonable assistance if a parcel is delayed, lost or damaged in transit. Nothing in this section limits any rights or remedies available to you under applicable law.
12. International orders
International customers are responsible for checking whether our products can lawfully be imported into their destination country.
Unless expressly included at checkout, international prices and shipping charges do not include import duties, customs fees, taxes or brokerage charges. These amounts may be collected by local authorities or the delivery provider and are the customer’s responsibility.
We are not responsible for delays caused by customs processing. If an international parcel is refused, unclaimed or returned because applicable charges were not paid, we may deduct reasonable return-delivery and recovery costs from any refund, to the extent permitted by law.
13. Returns, exchanges and refunds
Returns, exchanges and change-of-mind requests are governed by our Returns Policy.
To request a return, contact us at [insert customer-service email] within the period stated in that policy. Products must meet the applicable return conditions.
Change-of-mind returns may be unavailable for:

Custom or personalised jewellery

Engraved or altered pieces

Pieces made in a non-standard or specially requested size

Products marked as final sale

Products that have been worn, damaged, altered or returned in an unsuitable condition
Any exclusion of change-of-mind returns does not apply when a product fails to meet a guarantee under the Australian Consumer Law.
14. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a repair, replacement, refund, compensation or another remedy if a product:

Is faulty or unsafe

Is not of acceptable quality

Does not match its description

Is not fit for a disclosed purpose

Does not meet an applicable express warranty
The appropriate remedy may depend on whether the failure is major or minor and on the circumstances of the claim.
Nothing in these Terms excludes, restricts or modifies any consumer right, guarantee, condition, warranty or remedy that cannot lawfully be excluded.
15. Jewellery care and damage
Fine jewellery requires appropriate care. Exposure to impact, pressure, chemicals, cosmetics, salt water, chlorine, moisture, extreme temperatures or improper storage may damage metals, settings, gemstones, pearls and finishes.
Wear and damage caused by accidents, misuse, neglect, improper storage, unauthorised repairs or ordinary wear and tear are not necessarily manufacturing faults.
Please follow the care instructions provided on our website or with your jewellery. If you are unsure whether a cleaning method is appropriate for your piece, contact us before using it.
This section does not limit your rights where a product fails to meet a consumer guarantee.
16. Repairs
Contact us before sending any jewellery to Rommé for inspection or repair.
We may assess the piece and provide information about the available repair options, likely timeframe and any applicable cost. Repairs resulting from a manufacturing fault will be handled in accordance with the Australian Consumer Law.
We are not responsible for work performed or damage caused by an unauthorised third-party jeweller. However, third-party work does not automatically remove any consumer rights that continue to apply by law.
17. Promotions and discount codes
Promotions and discount codes:

May be subject to product or order-value restrictions

Cannot be exchanged for cash

May be limited to one use per customer or order
If a promotion has separate terms, those terms will apply in addition to these Terms and Conditions.
We may correct, suspend or withdraw a promotion affected by a genuine error, fraud, technical failure or misuse, subject to applicable law.
18. Gift cards
Gift cards are subject to any conditions displayed when they are purchased or issued.
Gift cards cannot be redeemed for cash except where required by law. Lost, stolen or incorrectly delivered gift cards may not be replaceable unless we can verify the card and its remaining balance.
Any applicable minimum expiry period required by Australian law will apply.
19. Website content and availability
We aim to keep our website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.
We may modify, suspend or discontinue part of the website where reasonably necessary. We are not responsible for temporary interruptions caused by maintenance, technical failures, third-party platforms or circumstances outside our reasonable control.
Product availability may change without notice.
20. Intellectual property
Unless otherwise stated, all content on the Rommé website is owned by or licensed to Rommé. This includes our name, branding, logo, jewellery designs, photographs, videos, graphics, written content and website layout.
You may access and use the website for personal, non-commercial purposes. You must not reproduce, modify, distribute, publish, commercially exploit or create derivative works from our content without our prior written permission.
You must not use Rommé’s product images, designs or branding to advertise, manufacture or sell another product.
21. Reviews and submitted content
If you submit a review, photograph, comment or other content to Rommé, you confirm that:

You created the content or have permission to share it

It is accurate and not misleading

It does not infringe another person’s rights

It is not unlawful, defamatory, abusive or harmful
You grant Rommé a non-exclusive, royalty-free right to display, reproduce and use content you intentionally submit for review, promotional or website purposes, subject to applicable privacy laws.
We may moderate or remove submitted content where reasonably necessary.
22. Prohibited conduct
You must not:

Use the website for an unlawful or fraudulent purpose

Attempt to gain unauthorised access to our systems

Introduce malicious code or interfere with website security

Scrape or automatically extract website content without permission

Impersonate another person

Submit false or misleading information

23. Third-party services and links
Our website may include services, applications or links provided by third parties, including Shopify, payment providers, social media platforms and delivery services.
Those third parties may apply their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot be excluded under applicable law.
24. Limitation of liability
To the maximum extent permitted by law, Rommé is not liable for indirect, incidental or consequential loss arising from your use of our website or products where that loss was not reasonably foreseeable.
Where liability cannot lawfully be excluded but can be limited, our liability will be limited only to the extent permitted by law.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, personal injury caused by negligence or any consumer guarantee, right or remedy that cannot legally be excluded or limited.
25. Privacy
We collect and handle personal information in accordance with our Privacy Policy.
By placing an order, you acknowledge that we may provide information reasonably required to Shopify, payment processors, delivery providers, production partners and other service providers involved in processing and fulfilling your order.
26. Changes to these Terms
We may update these Terms periodically to reflect changes to our business, website, services or legal obligations.
The current version will be published on this page with the date it was last updated. Changes will not retrospectively alter the terms applying to an order already accepted unless required by law or agreed with you.
27. Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.
28. Governing law
These Terms are governed by the laws of Victoria, Australia.
You and Rommé submit to the courts of Victoria and any courts entitled to hear appeals from them. This does not prevent you from exercising rights available under the laws that apply in your place of residence.
